How long does it take to get a registered trademark?

The full trademark registration process and approval can take anywhere from 9-18 months (the average is about one year).

My business isn't in the United States. Do I need a U.S. Registered Trademark?

Yes, if your market or customers are in the US! US trademark registration is essential for any business with a presence in the United States.

What's a trademark class & do I need more than one?

A 'class' is the goods or services you sell connected to the brand. For example, Starbucks is protected under Class 030 for coffee and food. If you're a coach, your services might include coaching, online training, etc. We help you figure this out. Classification is one of the main parts of the application process that can get complicated, so let us handle it!

Will a trademark keep someone from using my name?

A registered trademark means you own the right to use that name in your particular business niche. While it doesn't mean you can stop everyone from using the name, once you have the trademark, you CAN stop others from using it if they are selling similar goods or services.

Does a U.S. trademark protect me internationally?

No, but you can register in multiple countries. There is an application that allows for this once you've completed your US trademark registration. If you're interested, we can discuss this!

Is a trademark registration guaranteed?

Unfortunately, no! However, we won't proceed with your application unless we're confident in a high chance of approval. If we determine it's not a good bet, we will work with you to revise the name, or you can choose a refund, minus $500 for the cost of the initial trademark search and determination.

Do I need a lawyer for this?

No, anyone can file a trademark application. However, the process can be complicated. If the USPTO has any questions or sends an initial refusal, it can be confusing for non-attorneys. Sadly, many people give up at this stage, thinking their mark was refused for good, when in fact, they might just need to make a good legal argument. With our trademark attorney services, we guide you through every step.
